SwatchName is run by me, Russ, trading as SwatchName, UK. You can reach us at [email protected] or through the contact page.
Everything we sell is digital.
Naming a colour puts your name for it on a permanent public record. It does not give you legal ownership of the colour itself, any trademark or other intellectual property right in it, or any right to stop anyone else using it. What you are buying is the registry entry and the certificate.
Names are reviewed before they are accepted. We may refuse or remove a name that is offensive, misleading, or infringes someone else's rights.
Prices are shown before you pay. Payment is taken by card through Stripe, in pounds (UK) or US dollars (US). Your card details go straight to Stripe and are never seen or stored by us. If you use a discount code, the price you pay is the price shown after the discount.
If you live in the UK, you normally have the right to cancel an online purchase within 14 days. For digital content and services, though, you can ask us to start straight away, and in that case you lose the right to cancel once we have delivered.
Our digital products start immediately - the registry entry and the certificate PDF are produced as soon as you've paid. So before you pay, we ask you to tick a box confirming that you want your colour registered and your certificate delivered straight away, and that you understand you lose your right to cancel once that has happened. We then confirm this in the email we send after your order.
Refunds go back to the card you paid with, usually within a few working days. Nothing here limits your legal rights.
What we register is the exact hex value. How it looks on paper or on screen varies with your device, ink, paper and the light you're standing in - that's colour, not a misprint.
Your username appears next to the colours you've named. This is on by default, and you can switch it off in your account settings. If you delete your account, the colours you named stay in the public registry; your dedications, collection titles and certificate files are erased.
We take care over what we sell, but we can't promise the site will always be available or free of errors. Nothing in these terms excludes or limits any liability that can't legally be excluded, including for death or personal injury caused by negligence, or for fraud. Subject to that, our total liability to you for any order is limited to the amount you paid for it.
We may update these terms. The version that applied when you placed an order is the one that applies to that order. These terms are governed by the law of England and Wales. If you live elsewhere, including in the US, you keep any rights you have under the law where you live.
If anything here is unclear, ask us through the contact page.
